無期転換ルールの定年退職者への適用除外

有期雇用契約が5年を超えた場合の「無期転換ルール」の、定年退職者(再雇用)への適用については、法改正当初から疑念の声があがっており、一昨年から数度にわたる私のセミナー(改正労働契約法、改正高齢法)のなかでも、最も注意するべき点であると指摘してきたところでしたが、いよいよ、政府も重い腰を上げ、特例法が平成27年4月1日から施行されるようです。その結果、労働契約法の無期転換ルールは「定年退職後に再雇用されている労働者」には適用されないこととなりますが、特例が適用されるためには「事業主が計画を作成」する等、手続きをお忘れなく・・・・・・。
